Definitions & Interpretation
Definitions
In these Terms and Conditions, unless the context otherwise requires, the following expressions shall have the following meanings:
These Terms and Conditions together with any booking confirmation, house rules, and policies.
Any person who makes a booking, stays at the property, or uses services.
Bougainvillea Homestay located at [Address], Chikkamagaluru, Karnataka.
The owners, operators, employees, and agents of Bougainvillea Homestay.
A reservation for accommodation and related services at the Property.
All accommodation, food, beverage, and ancillary services provided.
Interpretation
In these Terms and Conditions, unless the context otherwise requires:
- Words in the singular include the plural and vice versa
- References to persons include natural persons, corporate or unincorporated bodies
- References to statutes or statutory provisions include those statutes or provisions as amended, extended, or re-enacted
- Headings are for convenience only and shall not affect interpretation
- "Including" means including without limitation
Booking & Reservations
Booking Procedure
All bookings are subject to availability and acceptance by Management. A booking is only confirmed when:
- Full payment or required deposit has been received
- Booking confirmation has been issued by Management
- Guest has provided valid identification details
- Guest has acknowledged acceptance of these Terms
Bookings made through third-party websites are subject to additional terms of those platforms. Management is not responsible for third-party booking errors.
Booking Requirements
All guests must meet the following requirements:
- Minimum age for booking: 18 years
- Valid government-issued photo identification required
- Foreign nationals must provide passport and valid visa
- Maximum occupancy per room must not be exceeded
- Any special requests must be confirmed in writing
Group Bookings
For group bookings (5 or more rooms):
- 50% non-refundable deposit required at booking
- Balance due 30 days before arrival
- Rooming list required 14 days before arrival
- Additional security deposit may be required
- Special cancellation terms apply
Check-in Procedures
Standard Check-in
Check-in time: 2:00 PM | Check-out time: 11:00 AM
- Early check-in before 10:00 AM: 100% room rate charge
- Early check-in 10:00 AM - 2:00 PM: 50% room rate charge
- Late check-out until 2:00 PM: 50% room rate charge
- Late check-out after 2:00 PM: 100% room rate charge
- All early/late requests subject to availability
Identification Requirements
At check-in, all guests must present:
- Original valid government-issued photo ID
- Booking confirmation/voucher
- Credit card for incidental authorization
- Foreign nationals: Original passport with valid visa
- Completed guest registration form
Management reserves the right to refuse check-in if identification requirements are not met. No refund will be provided in such cases.
Security Deposit
A security deposit is required at check-in:
Standard Deposit: ₹5,000 per room or credit card pre-authorization
Purpose: Covers incidentals, damages, and additional charges
Refund: Within 7-10 business days after check-out, subject to room inspection
Deductions: May be made for damages, missing items, or outstanding charges
Payment Terms
Payment Methods
Management accepts the following payment methods:
- Cash (Indian Rupees only)
- Credit Cards (Visa, MasterCard, RuPay)
- Debit Cards (Indian banks only)
- UPI Payments (PhonePe, Google Pay, Paytm)
- Bank Transfers (prior arrangement required)
Pricing & Taxes
All rates are quoted in Indian Rupees (INR) and include:
- 18% Goods and Services Tax (GST)
- Standard accommodation charges
- Basic breakfast (as specified in booking)
Additional charges apply for:
- Extra person (₹1,500 per night)
- Extra bed (₹2,000 per night)
- Additional meals and beverages
- Laundry and other services
- Special requests and amenities
Additional Charges
Service Charge: 10% on all food and beverage
Corkage Fee: ₹2,000 for outside alcohol consumption
Cake Cutting: ₹500 for celebration cakes
Lost Key: ₹2,000 replacement charge
Damage Charges: Actual cost + 25% administrative fee
Cancellation Policy
Standard Cancellation
Cancellation charges apply as follows:
- 48+ hours before check-in: Full refund
- 24-48 hours before check-in: 50% of total amount
- Less than 24 hours before check-in: No refund
- No-show: 100% of total amount charged
- Early departure: No refund for unused nights
Special Period Cancellation
During peak seasons and special periods:
- Festival periods: Non-refundable bookings
- Peak season (Dec-Feb): 7-day cancellation notice required
- Long weekends: 50% non-refundable deposit
- Special offers/promotions: Non-refundable
Modification Policy
Booking modifications are subject to:
- Date changes: Subject to availability and rate differences
- Room type changes: Subject to availability and rate differences
- Guest name changes: ₹500 administrative fee
- Modification must be made at least 48 hours before arrival
- Last-minute modifications may be treated as cancellations
Guest Conduct
General Conduct
Guests must adhere to the following conduct standards:
- Respect other guests' privacy and peace
- Maintain appropriate noise levels at all times
- No disruptive behavior in common areas
- Follow staff instructions promptly
- Comply with all house rules and regulations
Prohibited Conduct
The following conduct is strictly prohibited:
- Use of drugs or illegal substances
- Excessive alcohol consumption leading to intoxication
- Abusive language or aggressive behavior
- Smoking/vaping in non-designated areas
- Vandalism or damage to property
- Illegal activities of any kind
- Disturbing other guests after 11:00 PM
Management reserves the right to immediately evict any guest violating these conduct standards without refund. Legal action may be pursued for serious violations.
Age Restrictions
Minimum Age: Children below 10 years are not permitted
Unaccompanied Minors: Guests under 18 must be accompanied by adult guardian
Elderly Guests: Those requiring assistance must be accompanied by capable caretaker
Age Verification: Management may request age proof at check-in
Property Usage
Room Usage
Guests agree to the following room usage terms:
- Maximum room occupancy strictly enforced
- No cooking appliances allowed in rooms
- No smoking/vaping inside rooms
- No food or beverages in bedrooms
- No pets allowed (except service animals with prior notice)
- Room inventory must be maintained intact
Common Areas
Usage of common areas is subject to:
- Swimming pool: 7:00 AM - 8:00 PM only
- No glassware in pool area
- No alcohol consumption near pool
- Garden areas: No smoking or alcohol
- Common areas must be vacated by 11:00 PM
- Proper attire required in all common areas
Access & Security
Government Officials: Cannot enter premises without proper identification and permission
Visitors: Must register at reception and depart by 10:00 PM
CCTV: Surveillance in public areas for security purposes
Room Access: Management reserves right to enter rooms for maintenance, security, or emergency
Liability & Insurance
Limitation of Liability
Management's liability is limited as follows:
- Not liable for theft, loss, or damage to guest belongings
- Not liable for personal injury except due to proven negligence
- Maximum liability limited to room charges paid
- Not liable for consequential or indirect damages
- Parking area: Vehicles and contents at owner's risk
Guest Responsibility
Guests are responsible for:
- Securing personal belongings at all times
- Any damage to property caused by themselves or their visitors
- Medical expenses for any injuries sustained
- Compliance with all applicable laws and regulations
- Behavior of all persons in their booking
Insurance Recommendation
Guests are strongly advised to obtain comprehensive travel insurance covering cancellation, medical expenses, personal accidents, loss of belongings, and personal liability. Management does not provide any insurance coverage for guests.
Force Majeure
Definition
Force Majeure events include but are not limited to:
- Natural disasters (earthquakes, floods, storms)
- Acts of war, terrorism, or civil unrest
- Government actions, travel restrictions, or advisories
- Epidemics, pandemics, or health emergencies
- Strikes, lockouts, or labor disputes
- Utility failures beyond our control
Consequences
In case of Force Majeure:
- Management may cancel bookings without liability
- Refunds at Management's discretion only
- Alternative dates may be offered subject to availability
- No compensation for additional expenses incurred
- Guests must comply with government advisories
Privacy Policy
Data Collection
Management collects the following information:
- Personal identification details
- Contact information
- Payment details
- Government ID information
- Stay preferences and history
Data Usage
Collected data is used for:
- Booking processing and administration
- Legal compliance (government regulations)
- Service improvement
- Marketing communications (with consent)
- Security purposes
Data Protection
Retention: Data retained for 5 years as per Indian law
Security: Reasonable measures taken to protect data
Sharing: Shared only as required by law or with consent
Rights: Guests may request data access or deletion
Dispute Resolution
Governing Law
These Terms and Conditions are governed by:
- Laws of India
- Laws of the State of Karnataka
- Relevant hospitality regulations
- Consumer protection laws
Jurisdiction
All disputes shall be subject to:
- Exclusive jurisdiction of courts in Chikkamagaluru, Karnataka
- Indian legal procedures
- English as the language of proceedings
- Mediation encouraged before litigation
Resolution Process
Step 1: Written complaint to Management
Step 2: Mediation attempt within 30 days
Step 3: Legal proceedings if unresolved
Costs: Each party bears own costs unless ordered otherwise
Amendments
Amendment Rights
Management reserves the right to:
- Amend these Terms at any time
- Update policies without prior notice
- Change rates and charges
- Modify services and amenities
Applicability
Amendments apply:
- Immediately upon publication for new bookings
- To existing bookings if practical and reasonable
- Guests bound by terms in effect at time of booking
- Major changes communicated where possible
Amendment History
- Version 4.0 (Jan 1, 2026): Comprehensive revision including new privacy regulations
- Version 3.2 (Jul 15, 2025): Updated cancellation policy and liability clauses
- Version 3.0 (Jan 1, 2025): Major update to comply with new GST regulations
- Version 2.1 (Jun 30, 2024): Added pandemic-related Force Majeure clauses
Jurisdiction & Governing Law
These Terms and Conditions shall be governed by and construed in accordance with the laws of India. Any disputes arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Chikkamagaluru, Karnataka. By booking with Bougainvillea Homestay, you irrevocably submit to this jurisdiction.
Acceptance of Terms
By making a booking, checking into the property, or using any services, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions in their entirety. These Terms constitute a legally binding agreement between you and Bougainvillea Homestay.
